EU Returns, Cancellations & Consumer Rights

This policy applies to consumers purchasing from Aria Midnight who are resident in the European Union. Aria Midnight is a UK-based business specialising in personalised and custom-made jewellery.

Important: Nothing in this policy excludes, restricts or replaces any mandatory consumer rights available to you under applicable European Union law or the national consumer law of your country.

1. Personalised & Custom-Made Jewellery ```

The jewellery sold by Aria Midnight is predominantly produced specifically for the individual customer and may be made to the customer's specifications and/or clearly personalised.

This may include, but is not limited to:

  • personalised names and words;
  • initials;
  • dates;
  • numbers;
  • personalised geometric designs;
  • engraving;
  • birthstone selections;
  • customer-selected personalisation; and
  • jewellery manufactured specifically in accordance with details supplied by the customer.

Under Article 16(c) of Directive 2011/83/EU on Consumer Rights, the statutory right of withdrawal does not apply to the supply of goods made to the consumer's specifications or clearly personalised.

Accordingly, where an Aria Midnight product is genuinely made to your specifications or clearly personalised, you do not have an automatic 14-day change-of-mind right to cancel or return that personalised product simply because you no longer want it.

This exception applies only to the statutory withdrawal right. It does not remove your legal rights if an item is faulty, damaged, misdescribed, incorrectly personalised by us or otherwise fails to conform to the contract.

2. Please Check Your Personalisation Carefully ```

You are responsible for checking all personalisation and product options entered or selected before submitting your order.

This may include:

  • spelling;
  • names;
  • initials;
  • numbers;
  • dates;
  • capitalisation;
  • chain selection;
  • metal or finish selection;
  • birthstone choice; and
  • any other customisation supplied by you.

Your jewellery will be produced using the information supplied with your order.

If we manufacture the item correctly using the personalisation submitted by you, a spelling mistake, incorrect date, incorrect number or other error entered by you does not in itself make the product faulty or incorrect.

3. Cancelling Before Production ```

Although personalised goods may be exempt from the statutory EU withdrawal right, Aria Midnight offers a limited voluntary cancellation period before personalised production progresses.

Our current cancellation periods are:

  • Orders placed between 09:00 and 18:00 UK time may be cancelled within 2 hours of placing the order.
  • Orders placed after 18:00 UK time may be cancelled until 09:00 UK time the following morning.
  • Orders placed before 09:00 UK time may be cancelled within 2 hours of placing the order.

Please contact us as soon as possible if you wish to cancel.

A cancellation is not accepted until it has been confirmed by Aria Midnight. Once personalised manufacture or production has progressed, we may be unable to accept a voluntary cancellation.

These cancellation periods are an additional Aria Midnight policy and do not restrict any mandatory rights you may have under applicable law.

4. No Change-of-Mind Returns ```

Where a product qualifies as goods made to your specifications or clearly personalised, we do not accept a return or exchange simply because:

  • you have changed your mind;
  • you no longer want or require the item;
  • the item was purchased as a gift and is no longer required;
  • you supplied an incorrect name, spelling, date, number or other personalisation;
  • you selected the wrong finish or other personalised option;
  • you do not like a correctly manufactured personalised item; or
  • you expected a personalised arrangement to differ from the design produced in accordance with the product information and personalisation supplied.

This applies even where you contact us within 14 days of receiving the item, provided the product falls within the applicable legal exception for goods made to the consumer's specifications or clearly personalised.

5. Faulty, Damaged, Incorrect or Misdescribed Goods ```

The personalised-goods exception does not remove your statutory consumer rights.

If your jewellery:

  • is faulty;
  • arrives damaged;
  • does not match its description;
  • does not match the personalisation accepted with your order; or
  • otherwise fails to conform to the contract,

you may be entitled to a statutory remedy under applicable EU and national consumer law.

Depending upon the circumstances, this may include:

  • repair;
  • replacement;
  • a proportionate reduction in price; or
  • termination of the contract and a refund where legally available.

The appropriate remedy will depend upon the circumstances, the nature of the issue and the mandatory consumer law applicable in your country.

Where the law requires Aria Midnight to provide a remedy free of charge, you will not be charged for that remedy.

6. EU Legal Guarantee of Conformity ```

Consumers purchasing goods in the European Union benefit from a statutory legal guarantee of conformity.

As a general EU minimum, consumer goods are protected by a legal guarantee for at least two years. Individual EU Member States may provide longer periods or additional consumer protections.

The legal guarantee is separate from the 14-day right of withdrawal.

This means that although a personalised Aria Midnight product may be exempt from a change-of-mind return, you retain applicable statutory rights if the product is faulty or does not conform to the contract.

7. New EU Legal Guarantee Notice — From 27 September 2026 ```

From 27 September 2026, new EU rules require traders selling consumer goods to EU consumers to provide the official harmonised EU notice concerning the legal guarantee of conformity in accordance with applicable EU law.

The harmonised notice reminds consumers that consumer goods sold within the scope of EU consumer law benefit from legal guarantee protection of at least two years and explains the principal remedies available where goods do not conform to the contract.

For online sales, the prescribed harmonised notice must be displayed prominently as a general reminder on the trader's website in accordance with the applicable EU requirements.

From 27 September 2026, Aria Midnight will display the prescribed official EU harmonised legal guarantee notice to EU customers in accordance with those requirements.

The official harmonised notice is prescribed by European Union law and cannot be altered by Aria Midnight.

Its introduction does not create a change-of-mind return right for personalised or custom-made goods that are lawfully exempt from the statutory right of withdrawal. It concerns customers' separate statutory rights where goods are faulty or otherwise fail to conform to the contract.

8. Commercial Guarantees & The EU GARAN Label ```

The statutory legal guarantee described above should not be confused with a voluntary commercial guarantee of durability.

Aria Midnight does not, unless expressly stated on a particular product or elsewhere on our website, provide a separate commercial guarantee of durability beyond your statutory consumer rights.

Accordingly, the EU GARAN label does not imply that Aria Midnight provides an additional commercial durability guarantee unless such a guarantee is expressly offered.

If a qualifying commercial guarantee of durability becomes applicable to a product and EU law requires the harmonised GARAN label to be displayed, the appropriate prescribed label will be provided in accordance with the applicable requirements.

9. Damage in Transit ```

If your order arrives damaged, please contact us as soon as reasonably possible.

We may ask you to provide photographs of:

  • the jewellery;
  • the presentation packaging;
  • the postal or courier packaging; and
  • the damage complained of.

Photographs help us investigate and resolve the issue but do not remove or restrict your statutory rights.

Please retain the item and its packaging while your claim is being reviewed and until we provide further instructions.

10. Incorrect Personalisation by Aria Midnight ```

If we supply an item that does not match the personalisation accepted with your order, please contact us.

For example, if your accepted order specifies the name OLIVIA and we supply a different name, this may constitute a failure to conform to the contract and we will provide an appropriate remedy in accordance with your statutory rights.

If the product accurately reproduces the personalisation submitted by you, it will not normally be regarded as incorrectly personalised merely because an error was made when the order was entered.

11. Personalised Design Variations ```

Some Aria Midnight jewellery involves individually arranging letters, names or other personalised elements.

Where this is explained in the relevant product description, small variations in letter placement, spacing, orientation, proportions or overall arrangement may occur as a natural part of producing an individually personalised design.

For example, geometric personalised jewellery may require letters to be arranged differently depending upon the combination, shape and number of characters in the customer's chosen name.

Normal design variations do not in themselves constitute a fault where the finished item remains consistent with the product description, images and information supplied before purchase.

Nothing in this section allows Aria Midnight to supply goods that materially differ from what was agreed or advertised.

12. Earrings & Hygiene ```

Where legally applicable, certain sealed goods that are unsuitable for return for health-protection or hygiene reasons may lose their statutory withdrawal right once unsealed after delivery.

This may be relevant to certain earrings or other hygiene-sensitive jewellery where the legal requirements for that exception are satisfied.

This is separate from the exception applying to goods that are made to the consumer's specifications or clearly personalised.

Nothing in this section affects your rights where an item is faulty, damaged, misdescribed or otherwise non-conforming.

13. Non-Personalised Goods ```

If Aria Midnight sells an item to an EU consumer that is not made to the consumer's specifications, is not clearly personalised and does not fall within another statutory exception, the normal EU distance-selling withdrawal rules may apply.

Where those rules apply, an EU consumer generally has 14 days from receipt of the goods to notify us that they wish to exercise the statutory right of withdrawal, without needing to provide a reason.

This section does not create a withdrawal right for personalised or custom-made goods that are lawfully exempt under Article 16 of Directive 2011/83/EU.

14. How to Report a Problem ```

If you believe that an item is faulty, damaged, incorrectly supplied or not as described, please contact Aria Midnight and provide:

  • your full name;
  • your order number;
  • a description of the issue; and
  • photographs where reasonably useful in demonstrating the problem.

We aim to acknowledge customer complaints within 24–48 hours.

Please contact us before returning an item so that we can provide appropriate return instructions.

Where goods must be returned because they are faulty or otherwise legally non-conforming, Aria Midnight will bear the necessary return costs where required by applicable consumer law.

15. Refunds ```

Where you are legally entitled to a refund, it will normally be issued to the original payment method unless another method is expressly agreed where permitted by law.

Refunds will be processed within the time limits required by applicable consumer law.

If only part of an order is affected, any refund may apply only to the affected product unless applicable law gives you the right to terminate the wider contract.

16. National Consumer Rights ```

European Union consumer legislation establishes minimum protections. Individual EU Member States may provide additional or stronger consumer rights.

Nothing in these terms is intended to remove any mandatory consumer protection that applies to you under the law of your country where that law applies to your purchase.

If any part of this policy conflicts with mandatory applicable consumer law, the mandatory law will take precedence and the remaining provisions of this policy will continue to apply to the fullest extent permitted by law.

17. Governing Law ```

Subject to any mandatory rights available to consumers in their country of residence, these terms and any contract with Aria Midnight are governed by the laws of England and Wales.

Nothing in this clause deprives an EU consumer of the protection of mandatory provisions of consumer law that would otherwise apply to them.
